1. Agreement to Terms

By accessing or using SnapTimers ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SnapTimers provides email countdown timer creation and hosting services. Users can create customizable countdown timers that can be embedded in emails and web pages. The Service includes:

• Timer creation and customization tools
• Timer hosting and CDN delivery
• Analytics and view tracking
• API access (on eligible plans)

3. Account Registration

To use certain features, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscriptions and Payments

4.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your subscription plan.

4.2 Free Trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

4.4 Price Changes

We may change subscription prices with 30 days' notice. Price changes will take effect at your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

• Send spam or unsolicited commercial email
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute malware or harmful content
• Attempt to gain unauthorized access to systems
• Interfere with the Service or other users
• Create timers with illegal, offensive, or misleading content
• Use automated systems to access the Service (except via our API)

6. Intellectual Property

6.1 Our Content

The Service, including its original content, features, and functionality, is owned by SnapTimers and is protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you create using the Service. By uploading content, you grant us a license to host, display, and distribute your timers as necessary to provide the Service.

7. Service Level

We strive to maintain 99.9% uptime for timer delivery. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

8. API Terms

API access is subject to additional terms:

• API keys are for your use only and must not be shared
• Rate limits apply as specified in our API documentation
• We may revoke API access for violations of these Terms
• API access is only available on eligible subscription plans

9. Limitation of Liability

To the maximum extent permitted by law, SnapTimers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify and hold harmless SnapTimers and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SnapTimers operates, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or notice on the Service. Continued use after changes constitutes acceptance.
